In all the coverage you have seen, you have to read further to understand why the man was arrested, and convicted: simply put, the man was a software pirate!
Modding and selling the Xbox might be annoying to Microsoft, but, in my opinion, and remember that IANAL, it is not illegal, per se.
That said, selling modded Xboxes with 80 warez'ed programs already installed on the hard drive is very illegal. Compounding that by advertising and selling his (illegal) wares on the internet is unconscionable.
